Property Disclosure and the Law
Under California law, the seller of a property must disclose in the form of a transfer disclosure statement (TDS) any known defects and any past defects that have been corrected. A seller must also disclose any known nuisances that can affect the usability of the property. Even when the sale is on an "as is" basis, there are certain types of defects that must be noted in the property disclosure document.
