Nonexempt and Exempt Employees

The classification of an employee as either exempt or nonexempt is the key factor in wage and hour cases. An employee's job title is not important. The law provides a two-pronged test for determining employment status, based on your rate of pay and the job duties you preformed for more than 50 percent of your hours worked.
